Privacy Policy

This Privacy Policy (“Privacy Policy”) describes our policies and procedures on the collection, use and disclosure of Your information when You access the Website, download our Application, register for an Account, or otherwise use our Services. It also tells You about Your privacy rights and how the law protects You.

This privacy policy will not apply to websites which are linked to the Platform, over which Plannatech has no control.

Words that are capitalized are defined below. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access Our Service or parts of Our Service.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Application means the software program, named [Plannatech], provided by the Company and downloaded by You on any electronic Device.
  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Privacy Policy) refers to Plannatech.
  • Cookies are small files that are placed by a website on Your computer, mobile device or other electronic device, and track details of Your browsing history on that website. Further details regarding cookies are provided in this Privacy Policy.
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Location refers to legal and regulatory requirements Plannatech is required to collect.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Platform refers to the Application or the Website or both provided by Plannatech used by You for the Services.
  • Service refers to registering an Account on the Platform or by accessing or otherwise using the Platform, and the associated services.
  • Service Provider means any natural or legal person who processes data, including Personal Data, on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Website refers to Plannatech, accessible from [Plannatech]
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data

While using Our Service, We may ask You to provide Us with certain Personal Data including:

  • Email address
  • First name and last name
  • Phone number
  • Mailing Address
  • Gender
  • Date of Birth
  • Social Security Number
  • Location
  • Financial Information (i.e. Bank Account, credit card, prepaid card, PayPal account or other deposing or withdrawing method used on the website).

Usage Data

Usage Data is collected automatically when using the Service. As it is used to identify Your Device from which you are accessing the Service, it is considered Personal Data in some jurisdictions.

Usage Data may include Your Device’s Internet Protocol address (“IP Address”), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP Address of Your mobile device, Your operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Platform or when You access the Service by or through a mobile device.

Information Collected while Using the Application

While using Our Platform, in order to provide features of Our Platform, We collect, with Your prior permission:

  • Information regarding your location

We use this information to provide features of Our Service, to improve Our Service, and to customize Our Service. The information may be uploaded to the Company’s servers and/or a Service Provider’s server or it may be simply stored on Your Device.

You can enable or disable access to this information at any time, through Your Device settings.

We are required by Arizona State law to verify Your physical location when You engage in game play at on Our Platform, ensuring that You are playing on the Platform only from within Arizona state lines. To ensure compliance with the relevant Act and Regulations, information regarding Your physical location is collected using geo-location technology, provided by the Company or a third-party provider such as Xpoint. Confirmation of Your location within the State of Arizona may be stored for up ten (10) years as required by applicable state and federal laws and regulations.

Information collected from players playing from Our website/app: The geolocation software is embedded into the Plannatech app or WebsitePlatform to conduct location checks to determine if You are in or out of valid gaming areas in compliance with State law. To conduct the location check, Xpoint will collect Your Device ID and location information provided by Your mobile or computer device, including GPS data cell tower, Wi-Fi access point, or IP Address information, and using this information to provide Plannatech with the requested location verification services.

Information collected from players playing from Our Application: When You use Our Application, the Company or a third party provider such as Xpoint collects, with Your permission, Your precise location, which is determined from GPS, cell tower triangulation, Internet Protocol (IP) Address, Bluetooth, and WiFi access points. The Company or a third party provider such as Xpoint use this personal information to verify Your location to permit You to play on the Plannatech Platform in accordance with State law. You can adjust Your location access preferences anytime in Your mobile device settings. Please note that if You turn off location access, the Company or a third party provider such as Xpoint will be unable to verify Your location and, therefore, You may not be able to use the Plannatech Platform. You can stop all further collection of Your personal information by uninstalling the Application. After the Application is deleted, the Company or a third party provider such as Xpoint will retain the unique token assigned to Your Device through the Application and would be able to identify You if You decide to reinstall the Application. If You have enabled push notifications for the Application, You may disable these at any time by updating Your mobile device settings.

Collection of Geolocation data in relation to the law: Some federal laws prohibit and restrict wagering on the Internet (including, but not limited to, those stipulated in 18 U.S.C. §§ 1084 et seq. (The Wire Act) and 31 U.S.C. §§ 3163 through 3167 (UIEGA)). Such laws deem a Federal offense to have been committed should anyone physically located outside of the state undertake Internet wagering through a casino based in Arizona, including, but not limited to, placing a wager on the Platform, unless having been explicitly authorized by the Regulator (as defined in Our Terms and Conditions).

To verify Your physical location while You are wagering on the Platform, Plannatech and its Service Providers currently employ a number of technologies (referred to here as “Geolocation Technologies”), and may use such technologies in the future. The Geolocation Technologies We utilize inform on the physical location of the computer or Internet-connected Device from which You are accessing the Platform. Our Geolocation Technologies acquire Your physical location through the accessing of Your IP Address, MAC address, RFID, hardware embedded article/production number, embedded software number (such as UUID, Exif/IPTC/XMP or modern steganography), device GPS coordinates or Wi-Fi positioning system. The physical and geographic location of the computer or Internet-connected Device from which You are accessing the Platform is reported to us, Our Service Providers and/or the Regulator by the Geolocation Technologies We use. A correct or near-correct reporting of Your physical location may therefore be reported to us, Our Service Providers and/or the Regulator when You use the Platform.

ANDROID LOCATION DISCLOSURE 

Xpoint, our third-party geolocation SDK, needs permission from QUERY_ALL_PACKAGES to verify that patrons are in the appropriate state. The use of Query all packages ensures patrons are not using masking/spoofing apps to enable play from another state. It’s important to note that Xpoint was already granted an exception by Google to use it, providing reassurance about the legitimacy of our request.

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on Our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Service. The technologies We use may include:

  • Cookies or Browser Cookies. Browser Cookies are placed automatically on Your Device when
    you access a website, unless you instruct otherwise: You can instruct Your browser to refuse all
    Cookies or to indicate when a Cookie is being sent. However, if You do not accept Cookies, You

    the Company, for example, to count users who have visited those pages or opened an email and
    for other related Platform statistics (for example, recording the popularity of a certain section and
    verifying system and server integrity).

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To establish Your Account, including to conduct “Know Your Customer” review to confirm Your identity.
  • To confirm Your location within the state(s) where we offer our Service.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your Personal Data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Data obtained through the short code program will not be shared with any third-parties for their marketing reasons/purposes.

Children’s Privacy

Our Service is for individuals 21 and older. As such, we do not address or knowingly collect Personal Data from anyone outside of this age group If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone outside of this age group, we take steps to remove that information from Our servers.
